CNN —A federal appeals court ruled Tuesday that West Virginia cannot enforce its anti-transgender sports ban against a 13-year-old girl, dealing a blow to one of nearly two dozen such laws enacted by GOP-led states in recent years. We hold it cannot,” Circuit Judge Toby Heytens wrote in the decision, which was joined by Judge Pamela Harris. Signed into law by West Virginia Republican Gov. The court’s majority said the law violates Pepper-Jackson’s rights under Title IX, a federal law that prohibits discrimination on the basis of sex at schools that receive federal aid. The federal judge who initially blocked the law in 2021 reversed course last year and sided with state officials.

Senate Majority Leader Chuck Schumer recently discussed a long-shot idea with Sen. Joe Manchin: Making a late entry into the US Senate race in West Virginia to try to hold on to his seat as an independent. Manchin, who threw cold water on the idea and is still planning on retiring from the Senate, confirmed to CNN that he’s discussed the last-ditch bid with Schumer. “I think that’s a long, long, long-shot scenario,” Manchin said of running as an independent candidate. Blankenship ran as a Republican but lost in the 2018 Senate primary, later switching parties in 2024 to run in the contested Democratic primary to fill Manchin’s seat. “I understand the scenario,” Manchin told CNN.

The bill would bar counties from usurping state law on agricultural operations, including revoking such county regulations that were previously adopted. “This bill is of specific interest to many Hardy County residents because it contains language that would explicitly address a situation specific to Hardy County,” county planner Melissa Scott wrote in an email to The Associated Press. CHARLESTON, W.Va. (AP) — Five former correctional officers in West Virginia were indicted by a federal grand jury Thursday in connection with the 2022 death of an incarcerated man who was beaten while handcuffed and restrained in an interview room and later a jail cell. The indictments in West Virginia's southern U.S. District Court come weeks after two different West Virginia corrections officers pleaded guilty to a felony conspiracy charge stemming from the fatal beating of the same inmate, 37-year-old Quantez Burks. The case has drawn scrutiny to conditions and deaths at the Southern Regional Jail. Earlier this month, West Virginia agreed to pay $4 million to settle a class-action lawsuit filed by inmates who described conditions at the jail as inhumane. Two other former corrections officers were indicted Thursday on a charge of failing to intervene in the unlawful assault, resulting in Burks' death.

His stance on fossil fuels put him at odds with his party and he was frequently blamed for single-handedly quashing some of the Biden administration's most ambitious climate policy goals. Even as West Virginia overwhelmingly voted for former President Donald Trump in the 2016 and 2020 elections, Manchin easily won reelection in 2018. With Manchin gone, his successor will almost certainly be a Republican — most likely West Virginia Gov. Thanks to his GOP credentials and embrace of Trump, he's even less likely to be a climate ally than Manchin. Democrats, whose Senate majority is already slim, could lose that Senate seat for the foreseeable future — making any climate bills that much harder to pass.

Manchin never defended the remark but was criticized by West Virginia Republicans for what his party’s nominee said. John Deskins, director of the West Virginia University Bureau of Business and Economic Research, said 75% of West Virginia’s coal jobs were disappearing before coal production dropped because of mechanization. Senator Joe Manchin, a maverick who has often bucked party leadership in the past two years, said on Thursday that he will not seek re-election, hurting Democrats' chance of defending their thin Senate majority in the 2024 election. The move by the 76-year-old lawmaker will make it very difficult for Democrats to defend his West Virginia seat. "We like our odds in West Virginia," Senator Steve Daines, the head of Republican senators' campaign arm, said in a statement. David Bergstein, a spokesperson for the Senate Democrats' campaign arm, said the party was confident in its chances of strengthening its majority. Manchin has insisted that his only motivation is the coal-producing state of West Virginia and an eye on fiscal responsibility.

Senator Joe Manchin III said he decided to forgo re-election because he’d accomplished all his goals. But for the Democrats he’s leaving behind in Washington, the work to hold the party’s already slim Senate majority is just beginning. The state has become so conservative that only Wyoming delivered a wider Republican margin in the 2020 presidential race. “This is a huge impact,” Ward Baker, a former executive director for the National Republican Senatorial Committee, the group that oversees Senate races. “Manchin not running will save Republicans a ton of money — and it takes a seat off the board early.”

But the West Virginia senator’s Thursday announcement that he won’t seek reelection next year only refreshed a perennial question arising from his savvy instinct for accumulating power: What exactly is he up to? Second, the announcement immediately stoked speculation that Manchin is mulling a third-party presidential bid. Manchin’s decision to quit Washington comes as a formidable potential Republican challenger, West Virginia Gov. And if Manchin can’t win in the MAGA stronghold of West Virginia, it’s impossible to believe any other Democrat can. West Virginia was once a Democratic bastion, however.

The party in 2024 is defending Democratic-held seats in West Virginia, Montana and Ohio — all states that Trump carried handily in 2020. What Mr. Manchin actually plans to do remains a mystery. Mr. Manchin has flirted this year with No Labels, a group that has made noise about running a centrist candidate for the White House. Some allies of Mr. Manchin are skeptical that he will run for president. CHARLESTON, W.Va. (AP) — Sen. Joe Manchin of West Virginia has benefited from waiting to reveal where he stands as the swing vote in a chamber closely divided between Democrats and Republicans. During a multi-day trip to West Virginia's capital this week, the 76-year-old expressed growing frustration with the polarized U.S. two-party system. He managed to win reelection in 2018 in one of former President Donald Trump's most loyal states as the last of his party to hold statewide office in now-deep red West Virginia. Still, Justice has a high approval rating in West Virginia, making him a formidable opponent for any candidate.
